This article reviews the moral, religious, and legal foundations of privacy and confidentiality and discusses the distinction between these two closely related concepts. Current federal and state laws are reviewed, including HIPAA regulations and their implications for research and care in the emergency department. In the emergency department, privacy and confidentiality often are challenged by physical design, crowding, visitors, film crews, communication, and other factors. These problems are reviewed, and advice and guidelines are offered for helping preserve patients' dignity and rights to privacy and confidentiality.","is_dataset_classified":null,"base_score":4.02535169073515,"endowment":4.02535169073515,"datacite_reuse_total":0,"file_count":0,"downloads":0,"views":0,"has_version_chain":false,"is_dataset":false,"is_oa":false,"pmid":"16877134","pmcid":"PMC7132767","openalex_id":"https://openalex.org/W2044497988","authors":[],"funders":[],"total_grants":0,"fwci":0.6213,"citation_percentile":0.74701819,"influential_citations":0,"citation_trend":[{"year":2012,"count":6},{"year":2013,"count":4},{"year":2014,"count":1},{"year":2015,"count":2},{"year":2016,"count":4},{"year":2017,"count":1},{"year":2018,"count":3},{"year":2019,"count":2},{"year":2020,"count":2},{"year":2021,"count":2},{"year":2022,"count":6},{"year":2023,"count":8},{"year":2024,"count":3},{"year":2025,"count":5}],"oa_status":"green","license":"https://www.elsevier.com/tdm/userlicense/1.0/","oa_locations":[{"url":"https://www.ncbi.nlm.nih.gov/pmc/articles/7132767","host_type":"repository"},{"url":"https://www.ncbi.nlm.nih.gov/pmc/articles/7132767","host_type":"repository"},{"url":"https://api.elsevier.com/content/article/PII:S0733862706000332?httpAccept=text/xml","host_type":"publisher"},{"url":"https://api.elsevier.com/content/article/PII:S0733862706000332?httpAccept=text/plain","host_type":"publisher"},{"url":"https://doi.org/10.1016/j.emc.2006.05.005","host_type":"journal"},{"url":"https://pubmed.ncbi.nlm.nih.gov/16877134","host_type":"repository"},{"url":"https://europepmc.org/articles/PMC7132767","host_type":"Europe_PMC"},{"url":"https://europepmc.org/articles/PMC7132767?pdf=render","host_type":"Europe_PMC"}],"fields_of_study":["Patient Dignity and Privacy","Palliative Care and End-of-Life Issues","Medical Malpractice and Liability Issues","Biomedical Research","Confidentiality","Disease Notification","Emergency Medicine","Emergency Service, Hospital","Forms and Records Control","Hospital Design and Construction","Humans","Mandatory Reporting","Privacy","United States"],"mesh_terms":["Confidentiality","Emergency Medicine","Emergency Service, Hospital","Forms and Records Control","Hospital Design and Construction","Humans","United States","Disease Notification","Privacy","Mandatory Reporting","Biomedical Research"],"keywords":["Medicine","Confidentiality","Medical emergency","Patient confidentiality","Internet privacy","MEDLINE","Family medicine","Emergency medicine","Computer security","Law"],"sdg_mappings":[{"sdg_number":0,"sdg_label":"Peace, Justice and strong institutions"}],"linked_datasets":[],"clinical_trials":[],"software_tools":[],"database_accessions":[],"source":"live","citation_network_status":"fetched"},"created_at":"2026-08-17T02:02:16.662888Z","pmid":null,"pmcid":null,"fwci":null,"citation_percentile":null,"influential_citations":0,"oa_status":null,"license":null,"views":0,"total_file_size_bytes":0,"version_count":0,"fair_f":null,"fair_a":null,"fair_i":null,"fair_r":null,"fair_zscore":null,"fair_rationale":null,"fair_model":null,"fair_agent_version":null,"fair_fulltext_source":null,"fair_has_llm":null,"fair_computed_at":null,"clinical_trials":[],"software_tools":[],"db_accessions":[],"linked_datasets":[],"topics":[]}
